CARPARKING AGREEMENT

    In consideration of Operator agreeing to take custody of your Vehicle for the Purposes, You agree with Operator to be bound by the following terms and conditions.
       
  1. Subject to any statutory rights which cannot be varied or exempted You agree that Operator shall not in any circumstances whatsoever be liable for any loss of or damage to your Vehicle whether or not such loss or damage is caused by negligence or actions constituting fundamental breach of contract or the misdelivery of your Vehicle to an unauthorised person or theft or vandalism or trickery and You further agree that if this exemption of liability does not apply then to the extent that You may lawfully do so You agree to limit the liability of Operator to pay You for the loss and damage an amount not exceeding $300.

  2. You authorise Operator to drive your Vehicle both on the Premises and on public roads where necessary for the Purposes.

  3. Definitions:

    4. “Operator” means Priority Secure Park Pty Ltd CAN 102 345 755 as Trustee for the PSP Trust trading as both Budget Airport Parking and as Trustee for the Priority Secure Park Unit Trust trading as Priority Airport Parking and Breakthrough (QLD) Pty Ltd CAN 106 517 668 as Trustee for the Vehicle Storage Trust jointly and severally and the expression shall include where applicable their and each of their servants, agents and contractors.

    “Premises” means any premises (and if more than one jointly and severally) used for the storage of motor vehicles by Operator.

    “Purpose” means the storage of your Vehicle on the Premises and any optional services ordered by You such as having your Vehicle services, cleaned and/or detailed.

    “You” means the person named on this document as the person who delivered custody of your Vehicle to the Operator.

    “your Vehicle” means the motor vehicle detailed on this document, its accessories and any items of property located inside the motor vehicle.
